Tia Maria Canada – Tia Maria Room Twitter Contest

OFFICIAL RULES AND REGULATIONS

 

1. ELIGIBILITY: NO PURCHASE NECESSARY. Open only to Canadian residents of Quebec
18 years of age or older, void where prohibited or restricted by law, regulation, rule or otherwise.
Subject to all applicable laws and regulations. Sweepstakes begins at 4 p.m. EST, Monday
December 3, 2012 and ends at 11:59 a.m. EST on Wednesday, December 5, 2012. The
Sweepstakes Sponsor is Tia Maria Canada Inc. (hereinafter referred to as the “Sponsor”).

 
2. TO ENTER: To enter online go to www.Tia Mariacanada.com/currentcontests and read the
Official Rules, then visit www.twitter.com/TiaMariaCanada. Follow @TiaMariaCanada and retweet
the contest announcement. Upon submission, all entries become the exclusive property of Tia
Maria Canada Inc., (“Sponsor”) and no entries will be returned.
Entries will not be eligible if sent by any method not specified above or if received outside of the
Sweepstakes Period, or not in accordance with the Official Rules.

 
3. Prizes: There will be a total of one (5) PRIZES available. Prize consists of two (2) tickets to
the Tia Maria Room event taking place on December 6th, 2012 at The Club House in Montreal. All
other expenses associated with the Prize are the sole responsibility of the Winner. Including
transportation, food, beverage, merchandise and any incidentals.
Sponsor is not responsible in the event Winner and/or guest are refused entry to the event venue
for whatever reason and any unused portion of the prize will be forfeited.
Approximate total retail value of all Prizes is $0 CAD. No financial compensation will be made
when or if value is different to approximate retail value of prize quoted in these rules.

 
4. Prize Winner Selection: One (5) Prize Winners will be selected via random drawing by an
independent judging organization from all eligible entries received by Wednesday, December 5th
2012 at 5:00 p.m.

 
5. Odds of winning any Prize depend on the number of valid entries received. By
participating, entrants agree to be bound by these Official Rules and by the decisions of the
judging organization, which are final and binding in all respects. Each Prize will be required to
execute an Affidavit of Eligibility, Liability Release and/or Publicity Release (where legal) to be
returned within 48 hours of notification. Prize Winner will be notified via private message. In the
event of non-compliance with these requirements (including execution of the Affidavit of Eligibility,
Liability Release and/or a Publicity Release) or if Prize notification/Prize is returned as
undeliverable, Prize will be forfeited.

 
6. All other expenses not specified herein are the sole responsibility of each Prize Winner.
Prizes are subject to availability. Sponsor may substitute a Prize of equal or greater value if any
Prize becomes unavailable for any reason. Prize is nontransferable, and no cash or other
substitutions will be offered except at the sole discretion of Sponsor. Page 2 of 4
Prior to being declared a Prize Winner, selected Contestant must:
I. Be eligible according to these Official Rules;
II. Correctly answer a time-limited mathematical skill testing question (which will be
administered at a pre-arranged mutually convenient time) without the assistance of
another person or mechanical device; and
III. Complete, sign and return the required forms which shall serve as the Winner’s
agreement to release and indemnify Sponsor, and its and their respective parent(s),
subsidiaries, affiliates and/or related companies and each of their officers, directors,
shareholders, employees, advisors, assignees, agents, licensees, representatives,
advertising, media buying and promotional agencies from any liability in connection
with the Sweepstakes and/or the Prize.
If the selected Contestant fails to correctly answer the mathematical skill testing question,
does not return the completed and signed Form by the date specified on such Form, or
otherwise fails to comply with these Official Rules, the selected Contestant will be
disqualified and will forfeit his/her Prize and Sponsor may select another entry from among
all eligible entries remaining.

 
7. GENERAL CONDITIONS:
a) Limit one entry per person, per day, per twitter account. Only those entrants who are
following @TiaMariaCanada and have retweeted the contest announcement as described
above will be entered for a chance to participate. Multiple entries will result in the
disqualification of all entries from said entrant. Sponsor, nor any of their agencies are
responsible for any telephone, technical, network, electronic, computer, hardware or software
failures, malfunctions, or disconnects of any kind, or misdirected, illegible, incomplete, stolen or
garbled, fragmented, or delayed Internet computer transmissions or network/ISP/website/or
internet accessibility.
b) ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR
UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS IN VIOLATION
OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR
RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH
ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL
PROSECUTION. Sponsor reserves the right, at its sole discretion, to disqualify any individual it
finds, in its sole discretion, to be tampering with the entry process or the operation of this
Sweepstakes or web site; to be in violation of the terms of service of the web site, to be acting
in violation of these Official Rules; or to be acting in a non-sportsmanlike or disruptive manner,
or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic,
automatic, macro, programmed or like entry methods will void all such entries by such
methods. In the event of a dispute as to entries submitted by multiple users having the same
Twitter account, the authorized subscriber of the Twitter account used to enter the
Sweepstakes at the actual time of entry will be deemed to be the participant and must comply
with these Official Rules. Authorized account subscriber is deemed to be the natural person
who is assigned a Twitter account by an Internet access provider, on line service provider or
other organization which is responsible for assigning Twitter accounts or the domain associated
with the submitted Twitter account.Page 3 of 4
If, for any reason, the Sweepstakes is not capable of running as planned by reason of infection
by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures,
or any other causes which, in the sole opinion of Sponsor, could corrupt or affect the
administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor
reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend this
Sweepstakes.

 
c) Employees of Sponsor, and its parent or any of parent’s affiliate companies, subsidiaries,
agents, alcohol beverage distributors/ wholesalers, independent judging organization, retailers
(including bartenders/staff) and their advertising and promotional agencies, and the
employees/staff and the persons whom they are domiciled with are not eligible to enter or win.

 
d) Entrant releases Sponsor and its parents and parent’s affiliate companies, subsidiaries,
alcoholic beverage retailers, independent judging organization, distributors/wholesalers and the
directors, officers, employees and agencies of any of the above organizations from any and all
liability whatsoever for any injuries, losses or damages of any kind caused by participation in
the Sweepstakes or resulting from acceptance, possession, or use/misuse of any Prize. By
accepting any Prize, all Prize Winners consent to the use of their names and likeness for
advertising and trade purposes without additional compensation, except where prohibited by
law. Participants waive the right to assert as a cost of winning any Prize, any costs of
redemption or travel to redeem said Prize and any liability which might arise from redeeming or
seeking to redeem said Prize.

 
e) The provincial liquor agencies are not connected with this Sweepstakes in any manner
whatsoever, and are not liable in any way whatsoever in regard to any matter that relates to
this Sweepstakes.

 
f) By entering “Tia Maria Canada Tia Maria Room Twitter Contest”, the entrant is providing
Sponsor with written permission for Sponsor to send informative messages to entrant from time
to time.

 
8. This Sweepstakes shall be governed by and interpreted under the laws of the province of
Ontario, Canada, and the laws of Canada applicable therein without regard to its conflicts of law
provisions. All entrants to this Sweepstakes agree that all disputes arising out of or relating in any
way to this Sweepstakes shall be litigated only in courts sitting in Ontario, Canada.

 
9. This promotion is in no way sponsored, endorsed or administered by, or associated with,
Twitter. Any questions, comments or complaints regarding the promotion will be directed to
Community, not Twitter. Twitter is indemnified and held harmless from and against all damages,
losses, and expenses of any kind (including reasonable legal fees and costs) for any claim related
to the promotion including without limitation the publicity or administration thereof.

parents, affiliates, and subsidiaries are not responsible for the promotion, administration or
execution of this Promotion.
GENERAL: The invalidity or unenforceability of any provision of these Official Rules or the
Declaration will not affect the validity or enforceability of any other provision. In the event that any
provision of the Official Rules or the Declaration is determined to be invalid or otherwise
unenforceable or illegal, the other provisions will remain in effect and will be construed in
accordance with their terms as if the invalid or illegal provision were not contained herein.
Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that
provision. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings
are solely for convenience of reference and will not be deemed to affect in any manner the
meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or
inconsistency between disclosures or other statements contained in any Promotion-related
materials, privacy policy or terms of use on the Website and/or the terms and conditions of the
Official Rules, the French version of these Official Rules shall prevail, govern and control and the
discrepancy will be resolved in Sponsor’s sole and absolute discretion. Reference to third parties
in connection with Grand Prizes and/or third party websites or services are for reference and
identification purposes only and not intended to suggest endorsement, sponsorship or affiliation
with Sponsor or the Promotion.
